For the next year or so Individuals Under the Age of 17 are Considered Juveniles
Young individuals under the age of 17, who are facing misdemeanor or felony charges, are usually referred to the Juvenile Court system as opposed to regular court. Depending on the seriousness of the crime and the juvenile’s criminal background, a juvenile may be charged as an adult for crimes such as murder, rape, possession or dealing certain drugs, some gun offense, and some others. Schmierlaw can provide your child or a youngster you know with the experienced representation focusing on the potential educational and employment consequences for your child and the need to protect their future.

The Law is Changing. A Person between 17 year old will be considered a Juvenile.
Currently, Michigan is one of four states that treat all 17-year-olds charged with crimes as adults, regardless of their offense, however bipartisan legislation headed to Gov. Gretchen Whitmer's desk would raise the age at which teenagers are automatically prosecuted as adults in Michigan to 18. Lawmakers in the House and Senate introduced separate packages of "Raise the Age" bills in the spring and reached an agreement for the state to pay counties for the cost of adding 17-year-olds to the juvenile system for three years. The funding would then be reevaluated. The law wouldn't take effect until October 2021.

Prosecutors would still have the discretion to transfer 17-year-olds to the adult court system for certain serious crimes.
Generally, the juvenile system is oriented toward rehabilitation and offers more community-based alternatives to incarceration than the criminal justice system and gives 17-year-olds access to age-appropriate services, such as counseling and education.
Again, the law, although signed by the Governor, does not take effect for a couple years so Prosecutors will still charge under the current law
