Drunk Driving in Birmingham

If you are going to drink, don’t do it in Birmingham, West Bloomfield, Bloomfield Township or Bloomfield Hills
If you are arrested for OWI, (Driving While Intoxicated), the last place you want to do it is in these cities. If caught, you will go to the 48th District Court where you will have a good chance of going to jail. Judge Small is well known for putting drunk drivers in jail without exception. (Think Jalen Rose). So whether you are a big time sports figure or just an everyday Joe, YOU WILL GO TO JAIL. And you will go to jail even if that means losing your job, having a medical condition, having children that need caring for, or anything.

Michigan’s .08 blood alcohol limit means, that if you have more than a couple glasses of wine or a couple of cocktails, if you are pulled over and asked to take a Preliminary Breath Test, you just might fail even if you feel OK. Best advice; take a taxi, don’t drink or make sure there is a designated driver.

Spending 20 to 30 days in the Oakland County Jail is not a lot of fun, the fines are expensive, and, coupled with legal fees, getting stopped will make this the most expensive night out you ever had and will remain on your record for life.

If you do drink and get pulled over, refuse to take the PBT, (the breath test administered at the car), and unless you have injured someone, don’t refuse the breath test at the police station. (if you do, you stand to lose your license for a year).

Best advice, retain a competent OWI attorney who can protect your rights, look at all the facts, and give you the best advice on how to proceed.
